Please carefully review these Terms and Conditions and Privacy Policy before using the Application, whether you are a visitor or a registered User. If you do not agree to any of these terms, please refrain from using the TAWSILAT application and refrain from creating a special account or ceasing to use it. It is important to note that any presence or registration of an account or use of the application signifies acceptance and approval of the contents of these Terms and Conditions, as well as all other announced policies, which may be updated and published subsequently.
1. Definitions
The following terms, as used in these Terms and Conditions, shall carry the meanings specified below, unless the context requires otherwise:
Terms and Conditions: This agreement governs the relationship between TAWSILAT and the User, and outlines the rights and obligations of both parties.
TAWSILAT: The esteemed TAWSILAT Darkom institution of parcel transportation, serving meals, with commercial registration number 2511129965. It provides its Services through the Tawsilat Darkom institution of parcel transportation electronic Platform, with its address located in Hafar Al Batin. It may be referred to as "we, us, or our" in the Terms and Conditions.
User: An individual who registers an account with the TAWSILAT Platform or benefits from the Services of TAWSILAT. It may also refer to anyone who is present or browsing our Platform within the confines of the applicable Terms and Conditions.
Store: Any establishment, such as stores, restaurants, bakeries, sweets shops, and other businesses that showcase their products on the TAWSILAT Platform.
Representative: The individual responsible for delivering the order to the User.
Platform: The online application of TAWSILAT, through which the User can access or benefit from TAWSILAT Services.
Third Party: Any individual, whether possessing natural, general, or specific legal capacity. This may also include TAWSILAT and its representatives, depending on the context.
Use: The act of benefiting from any of the Services provided by TAWSILAT, as well as registering or being present on its Platform. This definition encompasses all verb tenses.
Personal Data: Any information that specifically identifies the User or renders them identifiable.
Violation: Any action or breach committed by the User, whether it violates any provision of the Terms and Conditions, laws, regulations, decisions, contracts, customs, or public morals applicable in the Kingdom of Saudi Arabia or in the country where the User utilizes the Services of TAWSILAT within its respective territory and jurisdiction. This definition encompasses all verb tenses.
2. TAWSILAT Services
TAWSILAT is a reputable electronic platform that offers a comprehensive paid Service, allowing Users to conveniently place orders from a wide range of reputable Stores. These Stores display their products and merchandise on our Platform, and we facilitate the payment and delivery process. It is important to note that TAWSILAT does not engage in the preparation, manufacturing, or offering of the products and merchandise featured on its Platform.
3. User Terms of Service
In order for Users to lawfully access and utilize the Services provided by TAWSILAT, the following conditions must be met:
3.1 Users of TAWSILAT must possess the necessary authorization, full legal capacity, and be at least 18 years of age. If a User is deemed incompetent or under the age of 18, their use of TAWSILAT Services and the application must be approved and supervised by a parent or legal guardian. The consent and supervision of the parent or legal guardian signifies acceptance and approval of the User Terms and Conditions, as well as other policies issued by TAWSILAT, which may be updated from time to time.
3.2 Users must not have had their account previously suspended, banned, or canceled by TAWSILAT.
3.3 TAWSILAT is to be used by Users solely for personal, non-commercial purposes.
4. User Obligations
4.1 Users are obligated to utilize the TAWSILAT application in a manner that is lawful, legitimate, and aligned with our mission and Services. This includes compliance with the User Terms and Conditions, adherence to public morals, and conformity with all applicable laws, regulations, and decisions issued by the jurisdiction to which TAWSILAT is subject, as well as the country in which the User accesses our Services and Platform.
4.2 Users acknowledge that the User Terms of Service are applicable to them, and they commit to abiding by the Terms and Conditions, as well as all policies established by TAWSILAT, which may be subject to updates.
4.3 Users bear the responsibility of ensuring the utmost accuracy and truthfulness of all data, information, addresses, and contact numbers they provide. Moreover, Users are required to guarantee that the payment methods they employ and submit are genuine and exclusively owned by them, or that they possess the necessary authorization to utilize and act upon them.
4.4 Users are obliged to safeguard their personal account information and maintain the confidentiality of their secret password. In the event that Users become aware of any unauthorized or illicit use or access, through any means, to our Services on their behalf or involving their personal account, secret password, name, or address, they are required to promptly notify (TAWSILAT).
4.5 Users are prohibited from allowing third parties to participate in or utilize their account. If Users grant others permission to act on their account, any actions taken by third parties will be deemed as the Users' own actions and will be their sole responsibility.
4.6 Users are expected to maintain constant internet connectivity and remain in proximity to communication devices specified in their account when requesting or utilizing (TAWSILAT) Services, until the completion of the Service or receipt of the requested items.
4.7 Users must refrain from including any content in their requests that may offend, abuse, harm, or harass others, including (TAWSILAT) and delivery agents. Users are also prohibited from sending, receiving, downloading, or uploading any material on or through our Platform that violates the terms, provisions, rules, regulations, decisions, or public morals, and are required to adhere to the content standards outlined in Clause (5) of the Terms and Conditions.
4.8 Users are strictly prohibited from processing, monitoring, copying, extracting, aggregating, merging, modifying, altering, or engaging in any other action related to the information, content, or data available or accessible through the (TAWSILAT) Platform. Users must refrain from displaying, adding, uploading, or downloading any illegal or unauthorized material, infringing on intellectual property rights in any way, or engaging in any activity that may directly or indirectly disrupt or compromise the operation or security of the (TAWSILAT) Platform. Furthermore, Users are prohibited from reverse engineering; reverse assembling, disassembling, or performing any computer or software operations or acts on the TAWSILAT Platform for any purpose.
4.9 Users are required to review the contents outlined in Clause (13) of these Terms and Conditions when evaluating the Services.
4.10 Users are accountable for any intentional or negligent violations, infringements, or breaches of any legal, customary provision, or agreement, including these Terms and Conditions. Users are responsible for compensating for any damages resulting from such violations.
5. Content Standards
5.1 Users must adhere to the Acceptable Content Standards, which apply to all content they enter, share, cast, send, download, upload, or display on the (TAWSILAT) Platform, as well as any interactive Services associated with it. Throughout their usage of the platform, Users must comply with the terms, conditions, public morals, laws, regulations, and decisions enforced in the Kingdom of Saudi Arabia, as well as in any country to which the User is subject while utilizing the (TAWSILAT) Platform and its associated Services.
5.2 The User is expected to provide accurate information, opinions, suggestions, and ratings in a sincere and trustworthy manner.
5.3 All user input, contributions, and posts must adhere to the following guidelines:
5.3.1 They must not contain defamatory, obscene, abusive, racist, hateful, instigative, sexual, violent, or discriminatory language or content based on race, gender, religion, nationality, disability, or age.
5.3.2 They must not infringe upon any copyright or intellectual property rights, including those of (TAWSILAT) or any other natural or legal person.
5.3.3 They must not induce harm or violate any legal obligations or duties towards third parties, including contractual or confidential obligations, or promote or support any illegal activities.
5.3.4 They must not include threats, abuses, assaults, privacy infringements, harassment, inconveniences, or any content likely to cause fear, embarrassment, or anger to any individual.
5.3.5 They must not impersonate any person or falsely attribute the User's identity to any individual or entity.
5.3.6 They must not engage in, participate in, endorse, promote, or support any illegal activities or acts, including but not limited to copyright infringement or computer misuse.
5.4 Users are required to adhere to the spirit and literal meanings of the Standards and Prohibitions outlined above.
6. User Responsibilities
6.1 Users have the responsibility to thoroughly review these Terms and Conditions, the Privacy Policy, as well as any updated or modified versions, and the notifications provided by (TAWSILAT) through the specified communication channels.
6.2 The User is obligated to update his data and information upon every change that occurs to it, otherwise the data and information registered with us will be considered and enforced according to Law. He must bear all the consequences or losses resulting from not updating them, including obstruction, inability or failure to deliver the request.
6.3 The User shall be held accountable for any consequences or losses resulting from their failure to comply with Clause (4.6) of these Terms and Conditions, which pertains to maintaining communication throughout the use of the Service until its termination, including any hindrance, incapacity, or failure to deliver the request.
6.4 The User shall assume full responsibility for the costs, fees, and losses incurred as a result of their cancellation or refusal to receive requests, or in cases where we are unable to deliver due to reasons attributed to the User, in accordance with the provisions outlined in Clause (11) of the Terms and Conditions.
6.5 It is the User's responsibility to verify the quality, type, reliability, and details of the products showcased on (TAWSILAT) and all related matters by directly inquiring with the Stores that offer and present their Services and products to the User through the (TAWSILAT) Platform.
6.6 The User is accountable for any misuse of the Services provided by (TAWSILAT) and for any violation of the User's obligations, including any breach of laws, regulations, decisions, norms, public morals, or infringement upon the rights of others.
6.7 The User shall bear any consequences that arise from providing, entering, or registering incorrect information.
6.8 The User is responsible for safeguarding their account information and data within (TAWSILAT), including the provision of their personal password to third parties, failing to secure it, or enabling others to access their account directly or indirectly.
6.9 The User shall be held responsible for any consequences resulting from their failure to promptly notify us of any unauthorized access to their data or account, as detailed in Clause (4.4) of the Terms and Conditions. Such notification does not absolve them of liability for any damages incurred.
6.10 The User shall indemnify (TAWSILAT) against any disputes or claims raised by (TAWSILAT) or third parties, arising from the User's errors, omissions, breaches, or violations of any contracts, laws, regulations, decisions, customs, or practices in their country of residence or the jurisdiction in which these infringements and violations occur. This includes all expenses and fees incurred by (TAWSILAT) in addressing, settling, or resolving such claims, including legal costs and attorney fees, even in cases where (TAWSILAT) incurs losses.
7. The TAWSILAT Limitation of Liability
7.1 (TAWSILAT) shall not be held liable for any damages, losses, or omissions resulting from delays or the inability to provide the Service due to external factors beyond its control, including but not limited to causes attributed to the User, force majeure, adverse weather conditions, or decisions made by official authorities or similar circumstances that are unforeseeable or unavoidable.
7.2 (TAWSILAT) assumes no liability for any damage incurred by the User while utilizing our Platform, including viruses or malicious programs that are not a result of our negligence or gross negligence, nor for any damage caused by third parties unrelated to us or beyond our control. This includes, but is not limited to, links and transfers made from our Platform to other sites and programs, the contents and security of which we do not guarantee. Please note that at (TAWSILAT), we take all necessary measures to ensure the safety of our Platform.
7.3 TAWSILAT shall not be held responsible for any misunderstandings or misuse of the Service by the User, or for any violations of the Terms and Conditions or applicable laws, regulations, decisions, customs, or public morals. Furthermore, we are not liable for any infringement upon the rights of others, including our representatives.
7.4 (TAWSILAT) does not accept responsibility for any incorrect data or contents of the products offered by the Stores available on the (TAWSILAT) Platform, including their compliance with food regulations, allergen information, type, nature, method of preparation, or contents. Additionally, we are not responsible for the quality of the products or their failure to meet the User's expectations. The responsibility for complying with laws, regulations, and decisions related to health and municipal affairs lies with the Stores and restaurants, and is beyond the authority and responsibility of (TAWSILAT).
7.5 TAWSILAT is not liable for the results of evaluations and comments provided by Users, nor for any losses that may arise from them. We are also not responsible for the recommendations presented to the User regarding products or Stores. These results and recommendations are based on estimated or automated statistical data derived from information, opinions, or data collected from Users.
7.6 TAWSILAT shall not be held responsible for any infringements, violations, or breaches of laws, regulations, decisions, customs, or public morals committed by individuals or entities over which we have no authority or supervision, and that are under the management, supervision, or authority of a third party. This includes infringements, violations, or breaches related to interactive Services involving oral or written means of communication that are not directly supervised by (TAWSILAT).
7.7 In general, (TAWSILAT) is not liable for any actions or events that are not a result of our infringement or negligence.
7.8 (TAWSILAT) will assume responsibility in the event of any failure or default in implementing a request, and will compensate the User accordingly in accordance with the provisions outlined in Clause (12) of these Terms and Conditions.
8. User Rights
8.1 The User shall be duly notified of any significant modifications made to the Terms and Conditions and the Privacy Policy. It is important to note that such modifications shall not be applicable to the User until one week after receiving the notification.
8.2 (TAWSILAT) is committed to providing the User with an electronic copy of their order invoice for their records.
8.3 The User shall be promptly informed if, for any reason, their request cannot be delivered as intended.
8.4 The User has the right to expect (TAWSILAT) and its representatives to adhere to all precautionary and preventive measures issued by the relevant official authorities.
8.5 The User's personal data will be safeguarded to the fullest extent possible through the implementation of necessary security measures and procedures. It will not be exploited, used, or shared for purposes other than those explicitly stated in the Terms and Conditions or in the updated Privacy Policy.
8.6 In the event of any breach of the User's personal data within (TAWSILAT) Platform and databases, the User will be promptly notified. The notification will include details regarding the breach, its potential effects, and the measures taken to address it. Such notification will be provided within (3) days from the date (TAWSILAT) becomes aware of the breach.
8.7 The User has the right to voice, receive acknowledgment, and address any complaints related to their experiences while utilizing the Services of (TAWSILAT), in accordance with Clause (14) of these Terms and Conditions.
8.8 Should the User decide to discontinue using the (TAWSILAT) Platform and terminate the processing and use of their personal data in accordance with the Terms and Conditions and the Privacy Policy, they may contact (TAWSILAT) to request the cancellation of their account.
9. TAWSILAT Powers
In addition to the Terms and Conditions, Privacy Policy, and any other applicable policies, (TAWSILAT) possesses certain powers that the User acknowledges and agrees to, as outlined below:
9.1 (TAWSILAT) retains the right to retain the personal User data and any information collected from their use of the (TAWSILAT) Platform, in any form or nature, while respecting the User's privacy within the boundaries and powers stated in the Privacy Policy. This retention shall continue until the User communicates with (TAWSILAT) to request the cancellation of their account.
9.2 (TAWSILAT) may utilize the User's personal data and contact information to relay any relevant statements concerning its Services, terms, policies, requests, complaints, and other pertinent matters. The User consents to the use of their contact information for the purpose of receiving advertisements, marketing materials, and promotional offers related to the Services of (TAWSILAT) or its affiliated Stores or the Stores displayed on the platform.
9.3 The personal and non-personal data and information provided by our esteemed users, whether collected, uploaded, sent, or entered, are processed for the sole purpose of enhancing the services offered by TAWSILAT. Furthermore, such data may be utilized to expand our customer base, encompassing both users and stores, as well as to conduct relevant research in accordance with the stipulations outlined in our Privacy Policy.
9.4 Any non-personal data and information acquired through the user's utilization of our application, encompassing their evaluations of stores, products, and services, as well as statistics derived from user activity on the TAWSILAT platform, may be disposed of. This disposal may involve reusing, selling, distributing, or transferring said data, without any obligation towards the user or any third party, provided that such actions are executed in a manner that ensures the user's anonymity.
9.5 TAWSILAT reserves the right to cancel, delete, suspend, or permanently ban any user account at any given time, without prior notice. Such actions may be taken due to a user's violation of content or acceptable use standards, any provision within the Terms and Conditions or for any other reason deemed appropriate by TAWSILAT, at its sole and absolute discretion. Furthermore, TAWSILAT reserves the right to pursue legal action against the user, necessitating the user to bear any associated legal costs and attorney's fees.
9.6 TAWSILAT retains the authority to delete, block, or ban any user comments, words, posts, or inputs of any nature on the TAWSILAT platform. This may occur due to violations of content standards or for any other reason, as determined by TAWSILAT, at its sole discretion.
9.7 TAWSILAT reserves the right to temporarily or permanently suspend its services or the operation of its platform, either in part or in its entirety. This suspension may be implemented for maintenance, updates, development, modifications, or any other purpose or reason, as deemed necessary by TAWSILAT, at its sole discretion. However, it is important to note that during such suspensions, users who are currently availing of our services will be entitled to compensation, as outlined in Clause 12.4 of the Terms and Conditions.
9.8 TAWSILAT retains the right to dispose of its ownership or engage in contracts with third parties for the purpose of delivering its services. In the event of such a transfer, the successor will be bound by these Terms and Conditions and the Privacy Policy until they are updated and the user is duly notified.
10. How Does The TAWSILAT App Work?
10.1 TAWSILAT platform provides users with the opportunity to select from a wide range of available stores that offer their services through our platform. Additionally, it offers a comprehensive list of products provided by these stores, including detailed descriptions, prices, and user evaluations. Furthermore, users can choose from a variety of payment methods based on their preferences. The platform also facilitates order tracking and enables seamless communication with delivery representatives.
10.2 The user has the option to place an order from one of the available stores displayed on the platform, based on their location. They can add desired products from the store's displayed list to their shopping cart. Additionally, users have the ability to include special requests for products by adding a note before adding them to the cart.
10.3 Once the user has finished selecting their desired products, they need to proceed to the cart section. Here, they must provide the exact delivery address and specify the preferred date for receipt. They can choose to receive the order at the earliest available time or schedule a delivery appointment by specifying the desired day and time.
10.4 Before submitting the request, the user must carefully review the application, invoice, and the information they have entered, including addresses, means of communication, appointments, and payment methods chosen from the available list. It is important to note that the contract is concluded as soon as the user clicks on "Send the request" and the store accepts it.
10.5 TAWSILAT reserves the right to decline the user's application for any reason, and in such cases, the user will be duly compensated for any amounts paid electronically in advance.
10.6 If the user makes an error while providing the required data to complete the application and is unable to modify the request through the platform, they should promptly contact TAWSILAT's Customer Service. The user can request a correction according to the following guidelines:
10.6.1 If the request is for the earliest available date, the user must inform us of the location of the error to facilitate the correction, provided that the store has not commenced processing the user's request during this timeframe.
10.6.2 In the case of a scheduled request, the user must notify us of the location of the error at least 24 hours before the scheduled delivery date, provided that the store has not started processing the user's order during this period.
10.6.3 It is important to note that the user's right to utilize this clause will expire once the specified period has elapsed, if they have already benefited from the received product or service, or obtained any form of benefit from them. For instance, this may include initiating the preparation of the request or receiving the request from the representative as a benefit derived from the service provided by TAWSILAT.
10.6.4 It is essential to understand that not every modification the user wishes to make qualifies as an error under the provisions of this section. The determination of whether an error can be corrected lies with TAWSILAT, in accordance with the provisions of this clause and the specific circumstances surrounding the situation.
To contact TAWSILAT's Customer Service and promptly inform us of the location of the error for correction, please ensure that the store has not commenced processing the user's request.
10.7 In the event of an unintended error in a statement or offer made to the User, we reserve the right to correct such error. However, we will promptly contact and inform the User of the error before initiating order processing, receiving the order, or delivering it to the User. The User will then have the option to proceed with their request after the correction or to cancel it. In the case of cancellation, the User will be appropriately compensated solely for the consequences of this error.
10.8 The termination of an order by the delivery representative is considered the completion of the Service and implies that the User has received their request. If a User terminates their order prior to receiving it, they must file a complaint within ten (10) minutes from the time the delivery representative terminated the order, as specified in Clause 12.5 of the Terms and Conditions.
10.9 Any additional charges imposed by the Store due to the inclusion of notes or special requests for a product will be the responsibility of the User and not covered by the invoice.
10.10 All data and details displayed in the Stores and their lists are the sole responsibility of the respective Store. We do not guarantee the accuracy of this information, and it is the User's responsibility to verify the details directly with the Store in accordance with Clause 6.5 of the Terms and Conditions.
11. Cancellation and Failure of the Request
11.1 The User is permitted to cancel their request as long as the Store has not initiated order processing. No financial charges will be imposed in such cases.
11.2 If the User wishes to cancel their order after the Store has already started processing it, they will be required to cover all associated financial costs.
11.3 In the case of a scheduled request made using the "Scheduled Appointment" feature, the User may contact Customer Service through the "Contact Us" feature to request cancellation before order processing begins. Failure to do so will result in the application of the provisions outlined in Clause 11.2 regarding cancellation.
11.4 If the User fails to receive the request despite accessing the designated site, it will be deemed as a cancellation after acceptance and preparation. Consequently, the provisions stated in Clause 11.2 will be applicable.
11.5 If the User cannot be reached due to incorrect addresses or contact information, or if they fail to maintain communication after submitting the request, a grace period of thirty (30) minutes will be granted from the time the representative arrives at the User-specified location. If this period elapses without any response or communication from the User, or without the request being received, the order will be terminated. Following this, (TAWSILAT) is not obligated to deliver the request or provide compensation for any violation of Clauses 6.2 and 6.3 of the Terms and Conditions.
11.6 (TAWSILAT) does not offer replacement or return services for any products requested or received by the User, regardless of their nature. The Store's return policies, which are beyond our control, will apply. Therefore, the User must directly contact the Store that owns the product for further assistance.
12. Compensation
12.1 In the event that a User receives a damaged or missing product from their order, or a product different from what was ordered, appropriate compensation shall be provided through one of the following means:
12.1.1 Attempting to deliver the same requested product or a similar product, taking into account any price differences as agreed upon.
12.1.2 Reimbursing the User for the value of the missing, damaged, or correct product.
12.2 If the ordered product is unavailable in the Store, the User is entitled to compensation in the form of the product's value if they have previously made an online payment.
12.3 If there is a delay in the delivery of the User's order, they shall be entitled to compensation for the delivery cost. A complaint must be filed by the User, and the request is considered late if it exceeds (60) minutes from the scheduled delivery time. Clause (1.7) of the Terms and Conditions may provide exceptions to this.
12.4 In the event of a disruption or suspension of the (TAWSILAT) Platform during the User's Service, before the request is delivered, for a duration exceeding (60) minutes without resumption, the User is entitled to compensation by refunding any previous electronic payment made for this request. This is provided that the User does not continue to be contacted by the serving representative or receive the request during this downtime.
12.5 Upon receiving the request, the User must verify its validity. If there are any observations or issues with the delivered request, the User must contact Customer Service within (10) minutes from the time of receiving the request to initiate the necessary actions for verification and compensation.
12.6 The provisions of force majeure mentioned in Clause (7.1) of the Terms and Conditions shall be taken into account as outlined in this Clause.
12.7 Compensation from (TAWSILAT) is provided by depositing the amount into the User's account wallet on the (TAWSILAT) Platform or by transferring the money to the User's bank account. The User must provide their bank account details to Customer Service at their own risk.
12.8 The process of depositing the amount into the User's bank account may take from 7 to 14 working days from the date of resolving the User's complaint and agreeing to provide compensation. In the event of any delay, the User should contact us to clarify any confusion and, if requested, obtain a copy of the refund notice to follow up with the bank.
13. Evaluation
13.1 Upon completion of the Service provided to the User, they may be requested to rate the Store they have dealt with, as well as the representative and Services of (TAWSILAT).
13.2 Only the actual User of the Service should perform the evaluation.
13.3 The User's evaluation of the Services, representatives, Stores, and products must be fair, honest, true, and accurate to the best of their ability. The evaluation should not be used for abusive, disparaging, misleading, or manipulative purposes, whether positive or negative.
13.4 The content standards and prohibitions stated in Clause (5) apply to the User's input and guarantees in the evaluation. The provisions of Clause (9.6) apply to the User's assessment.
13.5 (TAWSILAT) reserves the right, at its absolute discretion, to temporarily or permanently stop, suspend, or prevent evaluations for all, some, or one of its Users, for any reason.
14. Complaints and Suggestions
14.1 The User has the right to submit any notes, suggestions, complaints, or other feedback when encountering a reason to do so while using (TAWSILAT).
14.2 The User can submit their observations by contacting the Customer Service of (TAWSILAT) through the "Contact Us" feature on the (TAWSILAT) Platform. They can choose the appropriate type of note from the provided list and provide an accurate description of their feedback. The User may also be contacted directly by the (TAWSILAT) Customer Service team, and these calls may be recorded for the purpose of quality control of the User's Service.
14.3 At (TAWSILAT), we are committed to ensuring utmost satisfaction for our valued Users. We place great importance on actively listening to User suggestions and inquiries, and promptly addressing any submitted complaints. Our dedicated team conducts thorough investigations within two days of registering a complaint, and provides appropriate compensation in accordance with the cases outlined in Clause (12) of the Terms and Conditions. Users can conveniently track the progress and resolution of their registered complaints through the "Contact Us" feature on our esteemed Platform.
14.4 The content standards specified in Clause (5) of the Terms and Conditions apply to all communications between Users and (TAWSILAT) Customer Service through any available means of communication, ensuring a professional and respectful interaction.
15. Data Preservation
(TAWSILAT) diligently collects, safeguards, and processes User data and information while utilizing our Services and maintaining an account. 16. Protection of Intellectual Property Rights
All components of the (TAWSILAT) Platform, including intellectual, literary, and industrial property rights such as trademarks and copyrighted works, are safeguarded under international laws, regulations, and agreements. Any unauthorized actions, including deletion, alteration, addition, modification, distortion, sale, or licensing, copying, reproduction, reprinting, downloading, advertising, transmission, distribution, display, editing, creation of derivative works, or exploitation in any manner, for personal or commercial purposes, are strictly prohibited. Exceptions to these actions require prior written consent from (TAWSILAT), further reinforcing our commitment to protecting intellectual property rights.
17. Applicable Laws
All laws of the Kingdom of Saudi Arabia and the decisions issued by its official bodies shall apply to:
17.1 The Terms and Conditions, Privacy Policy, and any other policies advertised by (TAWSILAT), ensuring compliance and adherence to the legal framework.
17.2 The relationship between (TAWSILAT) and Users while utilizing (TAWSILAT) Services, as well as any disputes or claims arising from the use of the (TAWSILAT) Platform or Services, further solidifying our commitment to legal compliance and user satisfaction.
18. Dispute Resolution
18.1 Disputes arising from visiting our esteemed Platform, utilizing our Services, or violating any provision of the Terms and Conditions, laws, regulations, decisions, customs, or public morals shall be settled within the jurisdiction of the courts of the Kingdom of Saudi Arabia, specifically located in the city of Riyadh. This applies regardless of the User's city, country of residence, or the address of (TAWSILAT), ensuring a fair and just resolution process.
18.2 Prior to filing a lawsuit at the competent court in Riyadh, Users are kindly requested to report their complaints to (TAWSILAT) Customer Service. If a mutually satisfactory solution or amicable settlement is not reached within (15) days of reporting the complaint, Users may proceed to the competent court for adjudication. It is important to note that failure to follow this procedure may result in the User being liable for any fees, litigation costs, or attorney's fees incurred as a result of the lawsuit, even if (TAWSILAT) loses the lawsuit and subsequently settles it, further emphasizing the importance of adhering to the proper dispute resolution process.
18.3 The provisions of this Clause, as well as Clause 17, do not impede the right of (TAWSILAT) to pursue legal action against Users for violations of the laws of other countries, which have jurisdiction over crimes and violations committed by Users within their territories, highlighting our commitment to upholding legal obligations across borders.
19. General Provisions
19.1 The Privacy Policy, along with any other policies that we may advertise, are intended to complement and supplement the Terms and Conditions.
19.2 The failure of (TAWSILAT) to exercise any of its rights or powers as stipulated in the Terms and Conditions or other policies shall not be construed as a waiver or revocation thereof.
19.3 The invalidity of any provision within the Terms and Conditions or other policies, due to violation of any legislation, shall not impact the validity of the remaining provisions, which shall remain in full force and effect.
19.4 In the event of a conflict between the Terms and Conditions written in Arabic and any other language, the interpretation of the Arabic language version shall prevail.
19.5 (TAWSILAT) shall send notices and notifications to the mobile number or email address provided by the User in their account, and it is the User's responsibility to ensure that such contact information is kept up to date. Failure to do so shall not affect the validity or legal effect of the notices and notifications, in accordance with the law.
20. Amendment to Terms and Conditions
20.1 (TAWSILAT) reserves the right to amend the Terms and Conditions, Privacy Policy, or any other announced policy, at any time.
20.2 It is the User's responsibility to stay informed of any updates or modifications to the aforementioned documents since the date of their notification.
20.3 These amendments shall become effective and enforceable for the User after a period of one week from the date of notification.
20.4 Notification shall be deemed complete upon publication on the (TAWSILAT) Platform, accompanied by a clear indication of the modification, or by sending an electronic link to the User or an alert regarding the modification to the communication channels provided in the User's account. The User's failure to view or read such notifications shall not affect the completeness of the notification.
20.5 In the event that the User does not agree to any of the amendments, they must cease using the Services of (TAWSILAT) and exit the Platform. To ensure that their data is not used in accordance with the Terms and Conditions and Privacy Policy, the User must request the cancellation of their account.
